Types of family conflict

There are many ways that disputes can arise amongst families, and some examples include:

  • Divorce and SeparationDisputes over property, finances, and child arrangements can arise following a divorce or separation.
  • Child custody – Parents or relatives may dispute over child arrangements and custody following divorce, or when birth parents can no longer take care of a child.
  • Financial disagreements – A couple may disagree about how their assets are distributed and shared following a divorce or separation.
  • Cohabitation disputes – Disputes over property, finances and child arrangements can develop in unmarried, cohabiting couples after their relationship has broken down.

What is mediation in family law?

Family law mediation is a method of family dispute resolution. It aims to use negotiation and collaboration within a supportive environment in an attempt to find a solution outside of court. A third-party individual that is trained as a ‘mediator,’ such as a solicitor, will facilitate negotiations between the parties involved.

Mediation is often a quicker process than going to court and settling a dispute through negotiation can be less distressing. The family mediation process is also private and confidential, whereas journalists do have the ability to attend and report on family court hearings.

What is the mediation process?

Initially, you will attend a Mediation Information & Assessment Meeting (MIAM.) During this meeting, your mediator will talk you through the process and the other options for family dispute resolution.

Your mediator will aim to learn more about your circumstances, and determine if mediation is suitable for you. If your mediator thinks this is the right process for you, and both you and the other party agree to start the process, the mediation sessions can start.

Sessions are one to two hours long, and the amount of sessions you may require can vary based on the complexity of your case. You can choose to negotiate with the other party face-to-face, or you may wish for your mediator to facilitate a discussion while you are located in separate rooms, known as ‘shuttle mediation.’

Once you and the other party involved have come to an agreement, your mediator will draft a Memorandum of Understanding (MOU) document. This document lays out the details of your agreement, but it’s not legally binding. A solicitor can assist you in making this agreement legally binding if you both choose to do so.

But what if you can’t come to an agreement?
