DIY Divorce – Do I need a solicitor?

While it’s not a legal requirement to hire a solicitor for your divorce, there are many reasons why you may choose to do so. It’s particularly important to hire a divorce lawyer if your affairs are complex, such as when you share a lot of assets with your ex partner, or you cannot agree on child custody, asset distribution, or financial arrangements.

Advantages of hiring a solicitor for your divorce include:

  • Expert advice – Your solicitor can give you specialist legal advice throughout the divorce process, ensuring you are fully informed on what assets you are and aren’t entitled to.
  • Negotiation on your behalf – A solicitor will communicate with your ex-partner on your behalf, so you don’t need to worry about talking to them directly.
  • Avoid delays – Your solicitor will meticulously review your divorce documents, and ensure that they are completed correctly without mistakes. This will prevent delays resulting from faults within your application.
  • Reduced stress – Having the support and guidance of an experienced solicitor can allow you to feel more at ease throughout the process, so you can focus on your wellbeing during an already challenging time.

The stages of divorce

  • 1

The divorce process begins when one or both people in a marriage submit a divorce application, either through the GOV.UK online portal, the post, or a solicitor.

  • 2

The application is followed by a 20-week reflection period where the couple aim to settle their finances and make child arrangements. If an agreement can’t be reached, a divorce lawyer can help to facilitate negotiations between both parties through mediation.

  • 3

After the 20-week reflection period has passed, the divorce applicant(s) applies for a Conditional Order. Once the court has reviewed the Conditional Order application, and has determined that the couple is eligible for divorce, they will issue a Certificate of Entitlement.

  • 4

Following the Certificate of Entitlement, there is a 6-week waiting period before the applicant(s) can apply for a Final Order. Once the court has approved the Final Order, the divorce has officially been completed.
