What is TUPE?
TUPE stands for Transfer of Undertakings Protection of Employment. It is the protection employees get under the Transfer of Undertakings (Protection of Employment) Regulations 2006 if their employer is changed to another. This can happen when the company you work for has been bought out by another company, for example.
What happens to my original contract with my employer?
The new employer takes on the duties and responsibilities of the previous employer and so your original employment contract transfers to the new employer. This means that the terms in your contract such as your times of work are still valid.
There are circumstances where the new employer can change the original terms and conditions of your employment contract, this is only if the change made improves your terms and conditions or if they have valid economic, technical or organisational reasons.
Will I lose my job?
Under the Regulation, the change of employer means that the new employer cannot terminate the contract of employment of any person employed by the original employer (unless the employee objects to becoming employed by the new employer).
